  • restructuring and oversight of financially distressed companies (appointed as an Examiner by the U.S. Department of Justice),

  • litigation support and expert testimony (qualified as an expert witness in Maricopa County Superior Court, U.S. Bankruptcy Court, U.S. District Court, U.S. Tax Court).

 

He has extensive experience in providing guidance and services for financial institutions; is active in the promotion of mergers, acquisitions and financing alternatives for Valley businesses; has been instrumental in the formation of banks, their merger and sale and serving on their board and loan committees; and has current experience in performing concurring partner reviews on SEC engagements.

 

Tim has a long-standing tradition of activities that enhance business ownership and opportunity,founding and leading the M&A Round-table and reviving the Arizona chapter of the Association for Corporate Growth.

  • In a receivership engagement, assumed operations of an import and distribution company with a large number of out-of-state shareholders, facilitating shareholder meetings that resulted in the adoption of new corporate resolutions, board of directors and management.

  • On behalf of an international company, performed an analysis and provided a report that helped to substantially reduce an award of millions of dollars.

  • Performed the valuation of certain operations of a major airline in connection with the board of directors’ decision regarding sale.

  • Provided expert testimony central to a 2010 award of $44.8 million to Capitol Bancorp.

  • Provided expert testimony in the awarding of $11 million to in a successful counter-suit against McKesson Corporation.

  • In a bankruptcy trial, provided expert testimony that the Court found persuasive in exonerating the debtor of alleged misconduct.

  • Provided expert testimony on behalf of an insurance company in an $8 million bad faith claim trial that ended with a full defense verdict.

  • For the Arizona Attorney General, prepared a report and provided expert testimony that led to a substantial settlement in favor of federal and state agencies.

  • In a complex construction litigation matters, provided a special report that was accepted

  • by the parties and resulted in the exoneration of the defendant.
